What is a tenancy agreement (WA)?
This is a special type of contract. It is between a landlord and tenant. It allows the tenant to use a site for an agreed purpose. We also call it a ‘lease agreement’.
What are the types of tenancy agreement (WA)?
There are two general types – residential and commercial. A residential tenancy would be for a home. For instance, this would include a tenancy for a flat, an apartment, a villa or a house.
A commercial tenancy would be for any commercial use. For instance, a retail shop, an office, a warehouse or an industrial site. These are the main ones. But there are many others. It would include a lease for a hardstand. A ground lease where the tenant constructs a building on the land is also an example. These days, tenancies at the base of a mixed use strata complex are also common.
What is the difference between a tenancy agreement and a licence?
The difference is that the former gives ‘exclusive possession’. This means only the tenant can use the site. The tenant can exclude any person from the site. This includes the landlord.
A licence is not exclusive. Other people may access the site or move across it. A car park is a good example of this. This is also most common. But there are others. A landlord can grant a licence for a phone tower. Or a reception area. These days, hot desking is also common.
