When do I use an agreement for lease (WA)?
You need one when you do not know the key terms of the lease. For instance, when you do not know when the lease will commence.
There may be a number of reasons for this. You may not have bought or built on the site yet. Before you buy or build on land, your bank will often want you to sign up some tenants. This assures the bank that the project will be viable.
There may be a tenant still in the site. In this case, you cannot be sure that the tenant will leave on time. But you want to make sure that the new tenant is bound.
You or the tenant may need to do work on the site. The tenant may want some time to do a fit out. Or you may have agreed with the tenant to improve the site prior to leasing it.
Why do you need an agreement for lease (WA)? Can’t you just put these terms in the lease?
